Plant Breed Information
In accordance with Art. 248 of the Intellectual Property Law, “the issuance of a plant breed certificate protects all kinds and species of plants cultivated that entail an improvement of the plant inherited from plants so long as the cultivation and improvement are not forbidden for reasons of human, animal or plant health.”
Protection for wild species that have not been improved by man will not be provided.
The following are the requirements for filing an application for the registration of a plant breed:
ü Complete description of the procedure for obtaining a plant breed. The description must include:
- Genealogy
- Morphological, physiological, phitosanitary, phenologic, physical-chemical, industrial or agronomic characteristics that permit their identification in respect to analogous plants.
- Grounds for novelty, homogeneity, distinctiveness and stability.
- Geographical origin of the genetic materials that served as the basis for obtaining the breed to be protected.
- Reproduction or propagation mechanism.
- Photograph or any other technical element employed to illustrate morphological aspects.
1 Deposit of a live sample or document accrediting the deposit with a member authority of the UPOV, attaching the instructions that establish the principles, techniques and practices to administer the process of deposit of live samples.
2 Affidavit in respect to the marketing of the plant breed in the Andean Community and third countries
3 If priority will be claimed, a certified priority document together with a certification of filing issued by the appropriate office must be provided. Note that priority must be claimed in the registration application.
